Morocco divorce cases rise 4.38% in 2025
Total divorce and judicial separation filings reached 154,377, reversing a slight decline from the previous year, according to judicial data.
Morocco recorded 154,377 divorce and judicial separation cases in 2025, a 4.38% increase from the prior year. This rise follows a small decrease in 2024, when filings dropped to 147,895 from 151,168 in 2023. The Supreme Council of the Judicial Power's annual report, published in the Official Gazette, indicates that consensual divorce and judicial separation due to marital discord remain the most common reasons for ending marriages.
Divorce cases saw a slight uptick in 2024 to 40,212 from 40,028, and further increased by 1,252 cases in 2025. Judicial separation filings, however, experienced a decline in 2024 to 107,681 from 111,140, before rising by 5,230 cases to 112,911 in 2025. Consensual divorce constituted nearly 97% of all divorce cases throughout the three-year period analyzed.
The prevalence of consensual divorce is attributed to procedural flexibility and mutual agreement between spouses, which can mitigate conflict and reduce negative consequences for families. Judicial separation based on marital discord, known as shiqaq, accounted for the majority of judicial separation cases. The report distinguishes divorce as a dissolution of the marital bond and judicial separation as a court-ordered dissolution based on specified grounds.
