Court Voids EFCC Probe Report on London/Paris Club Refunds

A High Court judge ruled the EFCC overstepped its authority by investigating court-ordered payments to a consultant.

A Federal Capital Territory High Court has nullified an Economic and Financial Crimes Commission (EFCC) report that alleged fraud in the London/Paris Club refunds for Nigeria's 774 local government areas. Justice Suleiman Belgore stated the Federal Government acted improperly by directing the EFCC to investigate the matter, especially after two prior court decisions had already addressed the payments. The judge emphasized that the government should have pursued legal avenues to set aside the judgments instead of initiating a probe.

The court found that the EFCC's report was an affront to judicial authority, as it questioned judgments ordering payments to consultant Dr. Ted Iseghohi-Edwards for legal services. Justice Belgore noted that the government had already issued promissory notes for these payments following clearance from the Department of State Services. The judge affirmed that the terms of engagement between the Association of Local Governments of Nigeria (ALGON) and the consultant were renegotiated in court, and the subsequent promissory notes were validly issued.

The ruling upheld a suit filed by Dr. Iseghohi-Edwards, confirming he was legitimately retained by ALGON to represent the local government areas in the refund process. As part of the judgment, the court prohibited the Federal Government and its agencies from arresting, detaining, or prosecuting the plaintiff concerning this matter, thereby protecting his fundamental rights.

Why it mattersInvestors are affected because the court's decision impacts the legality and finality of payments related to government refunds, potentially influencing perceptions of regulatory and judicial processes.
